These Terms & Conditions ("Terms") govern your access to and use of the DevKicks platform, including our website, developer dashboard, advertiser portal, and the DevKicks VS Code extension (collectively, the "Service"), operated by DevKicks ("DevKicks", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age and capable of forming a legally binding contract to use the Service. By using DevKicks you represent that you meet these requirements and that the information you provide is accurate and complete.
2. The Service
DevKicks enables developers to earn revenue by displaying sponsored messages within supported developer tools, and enables advertisers to run campaigns that reach developers. Developer earnings are paid out in Indian Rupees (₹) via UPI, subject to the payout terms described below and successful completion of any required identity (KYC) verification.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraudulent or abusive activity.
4. Payments & Payouts
Advertiser payments and developer payouts are processed through our third-party payment partner, Razorpay. By making a payment you also agree to Razorpay's terms of service. Developer payouts are subject to a minimum payout threshold of ₹500 and to verification of your identity and payout details. We reserve the right to withhold payouts associated with invalid, fraudulent, or bot-generated impressions or clicks.
5. Acceptable Use
You agree not to misuse the Service, including by generating artificial impressions or clicks, reverse-engineering the platform, interfering with its operation, or using it for any unlawful purpose. Advertisers must ensure their campaign content is lawful, non-deceptive, and does not infringe third-party rights.
6. Intellectual Property
The Service, including its software, branding, and content, is owned by DevKicks and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
7. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, DevKicks shall not be liable for any indirect, incidental, or consequential damages, or for any loss of earnings, arising from your use of the Service.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bhilai, Chhattisgarh.
